Must have good character according to the standards of Islamic morality. Because no one's ijtihad can be considered trustworthy and reliable by the people. The respect of the people towards the law which is enacted through the ijtihad of characterless people cannot be created.

The purpose of describing these features is not that every ijtihadist must first prove that these features are present in him. Rather, its purpose is simply to show that the development of Islamic law through ijtihad, if it is to be on the right structure.

Then it can only happen when the law education and training system can produce scholars with the mentioned characteristics. Besides, the law that will be enacted will not be able to take its place in the Islamic legal system and the Muslim community will not be able to digest it as a good food.

The right course of ijtihad depends on the ijtihad and the law to be enacted on its basis. Whether the mujtahid wants to explain the law or does qiyas and istisbat, he must base his reasoning on the Qur'an and Sunnah.

On the contrary, he has to prove that the Qur'an and the Sunnah have not in fact laid down any guidelines or principles for such matters, nor have they laid down any basis for Qiyas.

Then the evidence that will be presented from the Qur'an and Sunnah must be in the way accepted by the expert scholars. In order to take evidence from the Qur'an, one has to take the meaning of a verse in the same way as the Arabic dictionary, grammar and conventional usage. In accepting this meaning, it must match the preceding sentence.

It will not conflict with the other narrations of the Qur'an on the same subject and its support must be present in the verbal or practical interpretation of the Sunnah or at least the Sunnah will not contradict this meaning. In addition to looking at the language and its grammar and precedents in order to receive evidence from the Sunnah, it is also important that the traditions from which support or evidence is being taken should be reliable according to the principles of Ilm-ul-Hadith.

Other reliable hadiths related to this subject should also be kept in view and no conclusion can be drawn from any one hadith which is contrary to other hadiths which are proved by reliable sources. The ijtihad that will be performed through the desired interpretation without aiming at these precautionary measures, even if it has the status of law.

But the collective conscience of the Muslims cannot accept it. And in reality it cannot be a part of Islamic law. This law will be thrown in the trash as soon as the political power that will execute it is deposed.
